Declaration of prior use Australian Trademarks


Has the government Examiner issued an adverse examination report cited a conflicting trademark? Do you need to submit a declaration that you used the trademark before the filing date of the conflicting application? If so you will need to complete a declaration of prior use.

This documents prepares a template Statutory Declaration for the purposes of showing Evidence of Prior Use for IP Australia.  Once the document is complete, further information will be required.  You will also need to confirm that standard matters described in the document are in fact correct.  The document must be signed before a person authorised for the purposes of statutory declarations.
